Applications due for NCU certificates

LIHU‘E, HI – October 10, 2008 – (RealEstateRama) — The Planning Department is reminding owners of single-family transient vacation rentals (TVRs) located outside of visitor destination areas that the deadline to submit applications for Non-Conforming Use Certificates (NCUs) is Wednesday, Oct. 15.

No late applications will be accepted.

A bill passed by the County Council earlier this year requires owners to register their TVRs or apply for a Non-Conforming Use Certificate.

The certificate application is available at the Real Property Assessment office located next to the Motor Vehicle Registration office at the L i hu‘e Civic Center.

This form is also downloadable from the county website, www.kauai.gov or www.kauaipropertytax.com on the forms and handouts page.

Applications must include the following items:

– An “as built” set of drawings stamped by a Hawai‘i-licensed architect or engineer, certifying that the drawings are true representations of the property as it exists today. As built sets should include plot and floor plans, elevations, and building section.

– Copies of general excise tax and transient accommodation tax records showing payment of taxes.

– Documents verifying operation of TVR prior to March 7, 2008 when the TVR ordinance was passed.

– Copy of “For the Safety and Comfort of You and Your Neighbors”.

If an applicant does not have all the required documents mentioned above, a completed application will be accepted with supporting documentation to follow.

Before issuing an NCU certificate, the Planning Department will review the application and supporting documentation as well as conduct site inspections.

Any person, firm, company, association, partnership or corporation found to be in violation of the TVR ordinance will be assessed a fine of not less than $500 or more than $10,000 for each offense.
