Modifications made to TVR ordinance

LĪHU‘E, HI – March 02, 2009 – (RealEstateRama) — The County Council recently passed a bill modifying the requirements for single family transient vacation rentals (TVRs).

The changes, now in effect, include the following:

– Timeshare owners are no longer required to register their property with the Finance Department.

– An applicant for a Nonconforming Use (NCU) Certificate whose property lies outside a visitor destination area must provide a sworn affidavit that his property was being used on an ongoing basis prior to the effective date of the ordinance, and was in compliance with all state and county land-use and planning laws. Those who have already filed an NCU application should submit an affidavit as soon as possible.

– Owners of single family TVRs must provide 24-hour contact information to neighbors adjacent to and directly across the street, the Planning Department, Kaua’i Police Department, Kauai Civil Defense Agency and Kaua’i Visitors Bureau.
